By accessing or using our website, digital twins, project management portals, or cloud-based construction interfaces (collectively, the "Services"), you agree to comply with and be bound by the following Terms of Use. If you do not agree to these terms, you must immediately cease using our Services.
1. Scope of Services & Digital Assets
Conta provides high-fidelity digital platforms to showcase our commercial and residential construction capabilities, facilitate project bidding, and host collaborative Building Information Modeling (BIM) data.
Informational Content: All descriptions, workflow metrics, architectural visual simulations, and case studies displayed on this website are for general informational purposes only. They do not constitute a formal, binding construction contract or engineered structural guarantee until explicitly signed in a physical Master Services Agreement (MSA).
2. Intellectual Property Rights
The Services contain highly specialized proprietary materials owned by or licensed to Conta:
Proprietary Graphics & Copy: All custom text, workflow structures, 3D renderings, and photographic portfolios are protected by international copyright laws.
Engineering Assets: Any conceptual structural frameworks, Grasshopper scripts, parametric massing algorithms, or BIM structures displayed or made accessible via our portals remain the exclusive intellectual property of Conta.
Limited License: You are granted a non-exclusive, non-transferable, revocable license to view the website content for internal evaluation purposes. You may not extract, reverse-engineer, scrape, or repurpose any structural layouts, computational matrices, or design data for external commercial usage without our express written consent.
3. User Accounts & Portal Security
To access structural data, field logs, or project schedules, users may be required to log into secure Conta client portals (e.g., integrations via Procore or Autodesk Construction Cloud).
Credential Integrity: You are solely responsible for maintaining the confidentiality of your authorized login credentials.
Prohibited Activities: You strictly agree not to deploy malware, execute unauthorized penetration testing, or upload corrupted CAD/BIM files that could disrupt our central cloud networks or compromise project database security.
4. Limitation of Liability
Conta operates with zero-tolerance engineering precision on-site, but our digital web platforms are provided on an "as-is" and "as-available" basis.
Data Latency: While we synchronize site telemetry and weekly drone scans rapidly, Conta does not guarantee that real-time field data, scheduling blocks, or material procurement tracking on the web portal will always be free from minor network latency or software-driven interruptions.
Indirect Damages: In no event shall Conta, its field superintendents, or structural partners be liable for any digital system downtimes, lost profits, or data corruption resulting from your use of this website. All structural and financial liabilities regarding physical builds are governed strictly by individual project construction contracts.
5. Third-Party Integrations & External Links
Our Services utilize advanced enterprise technology stacks (including Procore, Autodesk BIM 360, and Primavera scheduling frameworks). Conta does not control and is not liable for the uptime, operational updates, or privacy protocols enforced by these external third-party software providers. Your interaction with integrated software is governed by their respective corporate terms.
6. Governing Law & Jurisdiction
These Terms of Use are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. Any disputes, claims, or litigation arising out of or relating to the use of our digital platforms shall be submitted to the exclusive jurisdiction of the competent courts in Hanoi, Vietnam.
7. Modifications to Terms
Conta reserves the right to revise, update, or restructure these Terms of Use at any time to align with new cloud security updates, international data laws, or changing construction regulations. Your continued utilization of our portals after updates are published constitutes binding acceptance of the revised terms.
